Reviewing the seller’s contract or inspecting the unit is not enough. We review the title deed, the chain of transactions, the seller’s capacity, the property’s boundaries, restrictions and in-rem rights, powers of attorney, licences and utilities, to the extent the documents and competent authorities allow. We then provide clear notes on the safe points, risks and missing documents.
Foreign ownership and the rules governing use or registration depend on the buyer’s nationality, the type and location of the property, the purpose of the purchase, and any applicable restrictions or approvals. We therefore review each case individually before a deposit is paid, and clarify whether a direct purchase or another structure is lawful and suitable. Another buyer’s experience should not be relied upon as a general rule.
We ensure the property, price, payment and delivery dates, ownership warranties, tax and utility responsibility, delay and termination cases, and the refund and dispute-resolution mechanism are clearly defined. For off-plan units, we review the project description, licence, specifications, possible changes, delivery schedule and penalties.
We prepare clear lease contracts defining use, term, rent, increases, deposit, maintenance, utilities, assignment, subletting and handover. We also review notices, claims and cases of non-payment or misuse, and choose the appropriate legal procedure according to the type of contract and the facts.
When a conflict arises over ownership, refusal to deliver or register, or a dispute over price, we analyze the documents, correspondence and receipts before choosing litigation or negotiation. Registration, signature verification and contract-validity procedures each have different legal effects, so we explain the purpose of each route before pursuing it.
Its main purpose relates to verifying the signature, and it does not by itself replace checking the original title or taking the appropriate registration or validity procedures.
Not all cases are the same; there may be restrictions related to location, nationality, number of properties, or use, and the transaction must be assessed before signing.
Before paying a deposit or signing a reservation, so risks can be reviewed and protective terms set, rather than trying to amend the obligation after it has arisen.
