A customer’s failure to pay does not mean the first step should be filing a claim for the figure on an account statement. Commercial debt recovery in Egypt begins by checking the obligation, identifying the actual debtor, confirming maturity and evidence, and selecting a procedure suited to the file. The practical aim is to collect a recoverable amount while protecting the company’s rights during negotiations and proceedings.
Identify the party that owes the debt
A supplier may deal with a manager or employee while the contract is with a separate company. Check the company’s legal name, commercial registration, the signatory’s authority and any separate personal guarantee. A manager or shareholder is not presumed personally liable merely because they signed for the company; personal liability needs a specific legal or contractual basis.
Documents that support a creditor’s claim
- The contract, purchase orders and amendments setting the price and payment dates.
- Invoices together with proof of delivery or service acceptance; an invoice alone may not be enough.
- Acceptance records, progress reports and correspondence about objections.
- Prior transfers, acknowledgments or balance confirmations.
- An account statement separating principal, deductions, payments and additional claims.
Keep originals and organized digital copies. If the debtor disputes the quality of performance, gather evidence addressing that objection before treating the debt as final.
Make a demand without weakening your position
Prepare a clear demand stating the basis, amount and due date, and review the contract’s notice clause. A formal notice or demand for payment may be required depending on the chosen procedure. Keep negotiations in writing, but do not assume friendly correspondence preserves every legal deadline or interrupts limitation periods.
Debt lawsuit, payment order or arbitration?
Not every debt fits the same route. Assess the payment-order conditions where the claim is established in writing, due and sufficiently specified under the law. A dispute requiring accounting, expert evidence or review of performance may call for an ordinary action. If the contract contains a valid arbitration agreement, assess its effect before selecting a forum.
A settlement needs a workable payment plan
Record the acknowledged balance, instalment dates, transfer method, signatory’s authority and consequences of default. Link any final release to receipt of the agreed sums and review any waiver of claims or security. Do not hand over the original debt instrument in exchange for a verbal promise.
Consider enforcement before filing
Use lawful means to check the debtor’s business, addresses and assets that may be subject to enforcement. If there is a serious risk to recovery, counsel can assess whether a precautionary measure is available and what conditions apply. A judgment does not guarantee automatic payment, so enforceability belongs in the commercial assessment from the outset.
Frequently asked questions
Is failure to pay an invoice automatically a crime?
No. The relationship is generally assessed as a civil or commercial matter. Criminal proceedings require separate facts and legal elements and should not be used merely to pressure a debtor.
Is there a fixed time for collecting every debt?
No. Timing depends on the documents, jurisdiction, service, defences and enforcement. Plan from the actual file without promising a result or an uncertain date.
