Many entities call themselves “international” because they operate in several countries. A broad geographic presence does not automatically make an organization an intergovernmental body or grant it special immunities. In Egypt, legal classification comes before choosing a permit route, opening an office, hiring staff or arranging banking. Misclassification can send a complete application to the wrong authority.
Questions that shape the initial review
- Was the entity created by states under an international agreement, or by people or institutions under one country’s law?
- What are its founding documents, members and governing bodies?
- Is there an agreement with Egypt regulating its presence or office?
- Is the activity nonprofit civil-society work or a paid commercial service?
- Who will benefit in Egypt, and how will the activity be carried out locally?
Answers should come from authenticated documents, agreements and actual operations—not the organization’s website label or a donor’s description.
Intergovernmental organizations and special agreements
An intergovernmental organization may be created by an agreement among states, with its presence in Egypt governed by a specific legal arrangement. Read the relevant agreement and its scope, and distinguish the organization from its employees and contractors. Do not assume immunity, tax exemption or an exemption from a procedure merely because the other party has an international name.
Foreign non-governmental organizations
A foreign nonprofit seeking to conduct activities associated with Egyptian civil associations and foundations should be reviewed under Law No. 149 of 2019 and its Executive Regulations. This route requires an activity permit and brings obligations concerning funding, reports, accounts and personnel. Legal existence in the organization’s home country does not itself authorize activities in Egypt.
A company or initiative does not choose its legal regime by its name
Forming a consultancy does not allow every type of civil-society activity outside the applicable rules. Nor does an unregistered initiative become a separate legal entity by signing a memorandum of understanding. Review what happens in practice: who raises and spends funds, provides the service, signs contracts and bears obligations?
How classification affects an office lease
Identify the tenant, the signatory’s authority and the intended use of the premises. Where appropriate, the parties may agree that certain obligations begin after required approvals, using wording they have reviewed. Avoid documents suggesting that an office is a licensed branch before the relevant procedures are complete.
Review funding and personnel separately
Check the receiving account, source of funds, spending basis and any notice or approval requirements. Then review employment, social insurance, work authorization and residence status according to the entity and individual. An employee of a contractor working with an international organization does not automatically acquire the organization’s employee status or benefits.
Initial assessment file
Gather the founding documents, bylaws, representation resolutions, any Egypt-related agreement, activity and funding plans, and draft office, staffing and partnership contracts. The review should produce a clear procedural route, document list and allocation of responsibilities before major financial commitments are made.
Frequently asked questions
Does the word “International” prove the legal status?
No. The basis of establishment, legal status and relevant agreements control.
Does partnering with a local association exempt a foreign NGO from a permit?
Do not assume so. Review each party’s actual role in Egypt and the scope of required permits and approvals.
