A judgment from a court outside Egypt does not always allow immediate execution against the debtor’s assets in Egypt. Enforcing a foreign judgment requires identifying the applicable legal regime, reviewing treaties, conditions and documents, and finding the competent court. Foreign court judgments also follow a different procedural basis from arbitral awards.

Start with the country and type of judgment

Identify where the judgment was issued, the court, dispute, parties, and whether the decision was made in the parties’ presence or in their absence. Then check for an applicable bilateral or multilateral treaty. General rules should not be applied without considering treaties, which may affect conditions, jurisdiction or documents.

Which conditions need review?

Under the general rules of Egypt’s Civil and Commercial Procedure Law, review the foreign court’s jurisdiction, proper service and representation of the parties, whether the judgment is final under the issuing country’s law, whether it conflicts with an earlier Egyptian judgment, whether it violates public policy or morals, and reciprocity where applicable. Assess these matters together with the relevant treaty; a general statement that the judgment is final is not enough.

Prepare the foreign documents early

  • An official complete copy of the judgment, not an excerpt of its operative part.
  • Evidence of finality or legal force under the issuing country’s law.
  • Documents showing service and representation, where needed.
  • Required legalization based on the document’s origin and applicable system.
  • An acceptable Arabic translation and consistent party names.
  • Information about the debtor’s assets located in Egypt.

A company name written differently in the judgment and registry may cause delay. Prepare documents linking the names and proving representation instead of leaving the issue until enforcement.

Recognition or an enforcement order does not mean immediate collection

After following the required court process, the appropriate execution steps against assets in Egypt can begin. Check where the assets are, who owns them and whether prior rights burden them. A large judgment may still be difficult to collect if the relevant assets do not belong to the judgment debtor or are outside Egypt’s enforcement reach.

If you have a foreign arbitral award

Do not automatically treat an arbitral award as a foreign court judgment. Review the New York Convention and other relevant texts or agreements, the arbitration agreement, the seat, and the conditions for recognition and enforcement. The legal basis, competent court and possible objections depend on the type of award and the case record.

Frequently asked questions

Will the Egyptian court rehear the entire case?

The proceeding concerns recognition and enforcement conditions and the applicable review; do not assume it is an ordinary appeal of the foreign judgment.

Is an embassy stamp on the judgment enough?

Legalization addresses one aspect of a document. It does not replace finality, proper service or the other conditions.

Can we start before the translation is complete?

The judgment, original documents and treaties can be assessed first, but the application must include documents accepted by the competent court.
