Choosing the wrong procedure can delay debt recovery even when the underlying claim is strong. In Egypt, a payment order is a special route for certain claims that meet defined legal conditions; other claims proceed through an ordinary lawsuit. The distinction requires reviewing the full debt instrument, not merely noting that an amount appears on an invoice.

What is a payment order?

The Civil and Commercial Procedure Law provides a special process where the creditor’s right is established in writing and due for payment, and the claim concerns a specified sum of money or movable property meeting the statutory requirements. Special rules may apply to some claims based on commercial instruments. An invoice, cheque or promissory instrument should therefore be assessed on its own facts rather than assumed to fit one process.

Ask three questions before filing

  • Does the writing establish the obligation? Check the instrument, signature, authority of its issuer, and its connection to the contract and delivery records.
  • Is the debt due now? Review the payment date, any conditions precedent, and any later agreement to defer payment.
  • Is the amount specified? Distinguish a clear balance from a claim that requires accounting, assessment of damages or technical review.

Consider these questions together. A written contract may exist, but payment may depend on approval of work that has not yet been approved. Several invoices do not, by themselves, prove that the debtor accepted the final balance.

The demand for payment must be handled carefully

Before applying for a payment order, the creditor must demand payment in the manner and within the period prescribed by law; the general minimum period is five days. Check the address, evidence of service or delivery, and whether the demanded amount matches the supporting documents. An undocumented WhatsApp message does not automatically replace this step.

When might an ordinary lawsuit be needed?

A lawsuit may be appropriate where the amount depends on expert assessment, damages are unliquidated, or the special procedure’s conditions are not met. Do not choose an ordinary action simply because it seems easier: where the payment-order requirements are satisfied, the law may require the proper route to be followed.

A practical comparison

A client’s written acknowledgment of a defined, due balance presents a different file from a supplier’s unilateral invoice disputed as to quantity. In a construction contract, an approved payment certificate may need to be separated from a disputed claim for additional works. Similar amounts do not make their procedural positions identical.

Prepare an organized file for counsel

Arrange the original debt instrument, contract, proof of performance, any acknowledgment, demand for payment and party details chronologically. Attach a statement of payments and deductions so amounts already paid are excluded. Flag any arbitration clause, earlier dispute or challenge connected to the instrument.

Frequently asked questions

Does a payment order guarantee immediate collection?

No. Issuance, service, objections and enforcement depend on the circumstances. Practical recovery also depends on a valid file and assets available for enforcement.

Can estimated damages be added to every application?

An unliquidated claim may affect the available procedure. Assess all requested remedies together before filing rather than automatically combining every claim in one application.
