توقيع مستند قانوني يوضح الفرق بين صحة التوقيع وصحة ونفاذ

Buyers often confuse a signature-validity claim with a claim for specific performance of a sale contract, although their purposes and effects differ. Choosing the wrong route can cost time and money without providing the ownership protection the buyer expects.

What does a signature-validity claim address?

It is generally a conservatory procedure focused on whether a signature belongs to the person who made it. By itself, it does not determine that the seller owned the property, validate every contract term, or transfer title. Its principal function is to limit later denial of the signature within the legal scope of the judgment.

What is a specific-performance claim?

It concerns enforcement of obligations under the sale contract and, when the legal requirements are met, may support completion of the transfer of ownership. It generally requires broader review of the seller’s title, ownership chain, property description, and whether the transfer can be registered.

How to choose the procedure

  1. Define the goal: establish the signature or pursue transfer of ownership.
  2. Review the seller’s title before filing.
  3. Check whether the property and transaction can be registered.
  4. Confirm jurisdiction, evidence, and requested relief.

Proof of a signature alone does not answer whether the seller had title and could transfer it. A signature-validity judgment should not be represented as a substitute for registration. Whether specific performance is suitable depends on title, property type, and procedural and substantive requirements.
